1. Agreement to Terms

By accessing or using WordsUnite ("Service"), operated by WordsUnite LLC, a California limited liability company, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Age Requirements

You must be at least 13 years old to use the Service. By using WordsUnite, you represent and warrant that you are at least 13 years of age.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to terminate accounts that violate these Terms

4. Event Credits and Payments

Purchase Terms

• Event credits are purchased through our secure payment processor, Stripe
• Credits are non-transferable between accounts
• Prices are subject to change with notice

Refund Policy

Credits purchased are generally non-refundable, except in cases of:

• Severe technical issues preventing service use during your event
• Service outages during scheduled events
• Other extenuating circumstances at our sole discretion

User error, low event attendance, or dissatisfaction with event outcomes do not qualify for refunds. Future event credits may be granted in certain circumstances at our discretion.

5. User Content

Ownership

You retain all rights to content you create using WordsUnite, including but not limited to:

• Event titles and descriptions
• Chants and chant segments
• Messages sent during events
• Event location information (for public events)
• Any other content you create

License to WordsUnite

By using the Service, you grant WordsUnite a limited, non-exclusive license to display and transmit your content solely for the purpose of operating the Service.

Content Guidelines

You agree not to create or share content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on intellectual property rights
• Contains malware or harmful code
• Impersonates others or misrepresents affiliation
• Violates any applicable laws or regulations

6. Acceptable Use

You agree to use WordsUnite only for lawful purposes and in accordance with these Terms. You agree not to:

• Disrupt or interfere with the Service or servers
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to transmit spam or unsolicited communications
• Use automated systems to access the Service without permission
• Resell or commercially exploit the Service without authorization

7. Location Services

Event Locations

When creating public events, you are required to provide accurate location information. This helps users discover events in their area.

Location Privacy

• Your browser-stored location preference may be used to send approximate coordinates to our API to calculate distances; we do not store your personal location
• Location search preferences are stored only in your browser
• We use Mapbox for city search functionality via a server proxy; requests may include approximate coordinates to bias results but do not include user identifiers
• Event locations are visible to all users for public events

Accuracy

You are responsible for providing accurate location information for your events. Intentionally misleading location data may result in account termination.

8. Large Events

If you plan to host an event with more than 500 expected participants, we recommend contacting us at least 48 hours in advance at support@wordsunite.us. This helps us ensure optimal performance for your event.

9. Privacy and Data Protection

Your use of WordsUnite is also governed by our Privacy Policy. We are committed to:

• No advertising or tracking pixels
• No selling or sharing of user data
• No venture capital or investor influence
• Minimal data collection for service operation only (including essential authentication cookies and client-side storage for preferences)

10. Disclaimers and Limitations

Service Availability

While we strive for 100% uptime, WordsUnite is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

Limitation of Liability

To the maximum extent permitted by law, WordsUnite LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

11. Dispute Resolution

We encourage you to contact us first at support@wordsunite.us to resolve any disputes or concerns.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall be conducted in Sacramento, California.

Governing Law

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of WordsUnite after such modifications constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through the account settings.
